Imagine this: You’re a homeowner and you’re ready to renew the floor finish for the entire area covering your lounge, kitchen and hallways. You figure out your budget and spend time choosing a product. Finally, you take the plunge and a supplier sends you a contract and invoice for $15 thousand dollars to provide and install your new engineered hardwood floor finish.
Around 4 weeks later you notice that the edges of the floorboards have lifted up, you can feel it underfoot. It continues to get worse, until it’s clear that an area the size of a lounge rug has lost adhesion completely, presenting as a big hump in the middle of your floor.
What do you do?
Most people instinctively know the first step – to bring it to the attention of the party you paid to provide and install it, hoping that they will simply address the issue and leave you with the properly installed product you paid for.
But what if that supplier pushes back? The feeling of your stomach turning when you receive an email saying it’s your fault; there must be a leak in your house or you “over mopped”. That any issue of workmanship is an accusation that cannot be proven. And just like that, the supplier has cleaned their hands of the problem and walked away. You’ve been left with a completely ruined floor finish in your home and you’re $15 thousand dollars out of pocket.
This is what happened to Katrina and Chris.
Acting as agent on their behalf, Beyond Condition lodged a complaint for defective work with the Queensland Building & Construction Commission (QBCC).
Beyond Condition’s role began with a simple objective: bring structure to what had quickly become a confusing and stressful situation.
For most homeowners, the moment a contractor disputes responsibility is when the process becomes overwhelming. There are emails to interpret, technical claims to assess, and a regulatory process that most people have never encountered before. Katrina and Chris did not need another opinion thrown into the mix. They needed someone to manage the situation and move it forward.
Our scope of work therefore focused on three things: clarity, documentation, and process.
First, we established the factual basis of the complaint. That meant attending the property, observing the condition of the floor firsthand, and carefully documenting what could be seen and felt underfoot. When sections of flooring were later lifted during investigation, we were present to record what was revealed beneath the boards. Every observation was captured photographically and supported with clear written notes. No speculation, no exaggeration – just a disciplined collection of what could be objectively observed.
Those observations became the foundation of the complaint lodged with QBCC.
From there, our role expanded into managing the process on Katrina and Chris’s behalf. Anyone who has dealt with a regulatory investigation knows that it rarely moves quickly. There are periods of waiting, requests for additional information, and site meetings where multiple parties attend to present their position. Throughout that time, we acted as the single point of coordination. We followed up with the QBCC when updates were needed, ensured that deadlines were met, and kept Katrina and Chris informed at every step.
Equally important was being present whenever inspections occurred.
When the QBCC investigator attended the property, Beyond Condition represented Katrina and Chris’ interests on site. Questions were asked of the installer and supplier. Technical explanations were offered. At times these discussions can move quickly and involve terminology unfamiliar to homeowners. Our role was to listen carefully, ensure the relevant facts were captured, and help interpret what was happening in real time so Katrina and Chris were never left unsure about what had just been said.
Following the inspection meeting, we prepared a written record of what had been discussed and what information had been provided. Maintaining that paper trail is critical in regulatory processes; it ensures that positions taken during site discussions are accurately recorded and cannot later be reinterpreted.
Just as importantly, we managed expectations. From the outset the QBCC investigator explained that the process could take time. Investigations require evidence to be gathered and assessed before a decision is made. Katrina and Chris understood that they were entering a process that might stretch over many months. Our role was to guide them through it step by step, answering questions as they arose and keeping the focus on steady progress.
Eventually the investigation reached its conclusion.
The QBCC issued a Direction to Rectify to the supplier and installer. The decision required the defective engineered timber flooring to be removed and replaced in full, up to the nearest architectural break, by a specified date. It also required that any elements disturbed in order to carry out the rectification works – including the removal and refitting of kitchen base units – be properly made good once the flooring was correctly installed.
For Katrina and Chris, that decision brought clarity and certainty after months of uncertainty. The contractor was held accountable and, as directed, finally replaced the entire floor at their own cost through a licenced installer.
Disputes involving defective building work can quickly become emotionally draining. When a contractor disputes responsibility, homeowners often feel isolated and unsure how to move forward.
